User Agreement

1. General Provisions

1.1. This User Agreement defines the terms and conditions for using the internet service [https://konum.az](https://konum.az).

1.2. For the purposes of this Agreement, the following terms are used with the following meanings:

1.2.1. Service — an internet resource located at [https://konum.az](https://konum.az), including the website, mobile and other applications, software, design, databases, sections, subsections, as well as all information posted by the Administration and Users.

1.2.2. Administration — the company ESTON GROUP MMC, created and registered in accordance with the legislation of the Republic of Azerbaijan, administering the Service. All exclusive rights to the Service belong to the Administration.

1.2.3. User — a capable individual or legal entity that has accepted the terms of this Agreement and uses the Service.

1.2.4. Personal Account — the User's personal account in the Service, containing the User's settings and data.

1.2.5. Personal Account Balance — the User's virtual balance, used exclusively for payment of Service fees.

1.2.6. User's Personal Information — information provided by the User during registration and use of the Service, as well as information automatically transmitted to the Service (IP address, cookies, browser data, etc.).

1.2.7. Information — any content posted in the Service by Users or the Administration.

1.2.8. Spam — mass unwanted messages of an advertising, informational, or other nature.

1.2.9. Service Package — a paid set of services and bonuses, intended primarily for commercial Users. After activation, the cost of the package is non-refundable.

1.3. Terms not defined in this section are interpreted in accordance with the context of the Agreement.

1.4. Use of the Service is governed by this Agreement and applicable law.

1.5. This Agreement is a public offer.

1.6. By using the Service, the User confirms full and unconditional acceptance of the Agreement terms.

1.7. Use of the Service on behalf of a legal entity means acceptance of the Agreement by such entity.

1.8. The Administration has the right to unilaterally change the terms of the Agreement.

1.9. In case of disagreement with the terms, the User must stop using the Service.

1.10. The Service provides a platform for posting and searching listings.

1.11. Certain services may be governed by special rules.

1.12. Materials and services may be accompanied by advertising. The Administration is not responsible for the content of advertising.

1.13. Registration in the Service is voluntary but provides access to additional features.

1.14. The User is obliged to maintain the confidentiality of login and password and is responsible for all actions performed in their account.

1.15. The Administration has the right to use technical means to verify the provided data.

1.16. The Administration does not guarantee the accuracy of information provided by Users.

1.17. Users are recommended to independently verify counterparties.

1.18. The Administration has the right to restrict or terminate User access in case of violation of the Agreement.

1.19. User access may also be restricted in case of violation of legislation or rights of third parties.

1.20. Blocked Users are not entitled to register again without the permission of the Administration.

2. Using the Service and Posting Listings

2.1. Posting listings is allowed for both registered and unregistered Users.

2.2. Actions that violate legislation, rights of third parties, or normal operation of the Service are prohibited.

2.3. All transactions are concluded directly between Users. The Service is not a party or intermediary in such transactions.

2.4. Comments and other materials must comply with legal requirements and moral standards.

2.5. The Administration is not responsible for the content of external resources, links to which may be present in listings.

2.6. By posting materials, the User grants the Administration a free, perpetual, non-exclusive right to use, reproduce, distribute, publish, and display them.

2.7. The User is responsible for violation of third-party rights.

2.8. The User is obliged to provide accurate and up-to-date information in listings.

2.9. By posting a listing, the User confirms having the rights to perform the relevant actions.

2.10. The User guarantees having all necessary permissions and rights to the posted content.

2.11. The Administration has the right to request supporting documents and suspend publication of the listing until they are provided.

2.12. The number of active listings may be limited.

2.13. Listings containing illegal, offensive, or prohibited content are prohibited.

2.14. Use of paid services does not guarantee retention of the listing in case of violation of the Agreement.

2.15. Automated posting of listings without written permission is prohibited.

2.16. Viruses, fraud, extremism, pornography, and other illegal materials are prohibited.

3. Paid Services

3.1. Users may order paid services of the Service.

3.2. Types of services include:

• Search promotion

• VIP

• Premium

• Paid listing

3.3. Prices and payment procedures are indicated on the relevant pages of the Service.

3.4. The decision on refund is made by the Administration.

3.5. Refunds are not made in case of service activation or violation of the Agreement terms.

4. Bonuses

4.1. Bonuses are used exclusively within the Service and are not exchangeable for money.

4.2. Bonuses may be provided as part of packages or as a gift.

4.3. Upon expiration, bonuses are canceled without compensation.

5. Communications

5.1. The Administration has the right to send notifications to Users by email and SMS.

5.2. Messages may be of an advertising and informational nature.

5.3. The User has the right to opt out of receiving notifications.

6. Software

6.1. All rights to the Service software belong to the Administration.

6.2. The User is granted a non-exclusive license to use the Service.

6.3. Copying, modification, distribution, and decompilation of software without written permission is prohibited.

7. Limitation of Liability

7.1. The Service is solely an information platform.

7.2. All risks associated with concluding transactions are borne by the User.

7.3. The Administration is not responsible for the content of listings.

7.4. The total liability of the Administration is limited to the amount paid by the User for Service services.

8. Term of Agreement

8.1. The Agreement enters into force from the moment of starting to use the Service and is valid indefinitely.

8.2. The Administration has the right to terminate User access at any time.

9. Other Terms

9.1. Disputes are resolved through negotiations.

9.2. The legislation of the Republic of Azerbaijan applies.

9.3. A new version of the Agreement enters into force from the moment of publication on the Service.

9.4. The invalidity of one provision does not entail the invalidity of the Agreement as a whole.

9.5. Inaction of the Administration does not mean a waiver of protection of its rights.
